Two federal death row inmates are asking to be exempted from outgoing President Joe Biden’s order commuting their sentences to life in prison without parole, as they seek to appeal their cases and prove their claims of innocence.

The men had been acquitted by a jury of the murder of a police officer, but the judge had concluded that they had been involved and sentenced them to life in prison.

President Joe Biden will commute the sentences of nearly 2,500 non-violent drug offenders in one of his final official actions before leaving office. The people receiving the commutations have been serving “disproportionately long sentences compared to the sentences they would receive today under current law,
